These General Terms and Conditions only apply to online sales on www.divinawine.ch.

We consider our customers as business partners, too. We guarantee them friendly and flexible collaboration. For this reason, our General Terms and Conditions form the basis for a fair partnership.

Prices
The prices apply for private customers and are strictly net and inclusive of VAT. We reserve the right to adjust prices and product designs at short notice to suit market conditions.

Pick-up drivers

Products may be picked up at the following times:
Monday – Thursday, 8:00 a.m. – 12:00 p.m. and 1:00 p.m. – 5:30 p.m.

Friday 8:00 a.m. – 12:00 p.m. and 1:00 p.m. – 5:00 p.m.

Terms of delivery For orders totalling CHF 300.- or more, we offer a free delivery service based on our vehicle route – if the point of delivery is outside of our delivery area or in the case of orders whose total value is less than CHF 300.-, delivery shall be made via the VinoLog service of Swiss Post. A shipping fee of CHF 16.00 (inkl. VAT) will be charged per package (box of 6, box of 12 or gift box).

Complaints, corked wines & returned products
We place great value on top quality products, careful packaging and correct execution of your orders. Nevertheless, if you have a justified complaint, we ask that you notify us thereof within 2 days of receiving your goods (transport damage and incorrect quantities must be recorded on the delivery note as soon as you receive the goods). Products which are handled inappropriately cannot be replaced or reimbursed.
Provided that they are handled and stored correctly, corked wines may be replaced within 18 months of delivery at the latest. The bottles must still contain 2/3 of the contents and be returned with the original corks.
Products returned without prior notification and without our approval will not be accepted.

Terms of payment
Our invoices are payable in full within 10 days, strictly net and in Swiss francs. You will subsequently be charged for any unjustified or unauthorised deductions. In the event that these conditions are not adhered to, we shall be forced to impose interest on arrears and late payment fees. In the event that the customer is in arrears with his/her payments, we reserve the right not to process any orders placed by him/her or to make execution of the orders dependent on the payment of any outstanding invoices.
All goods supplied by us remain our property until they have been paid for in full.

Purchase entitlement
Legal regulations in Switzerland prohibit the sale of alcoholic drinks to young people under the age of 16, while spirits may not be sold to anyone under the age of 18.
By placing an order, the orderer agrees to the above provisions and confirms that he/she is entitled to purchase alcohol.

Data protection Personal customer data is treated confidentially pursuant to applicable data protection legislation and is neither passed on nor sold to third parties. Sensitive data, in particular details when paying by credit card, is transmitted in encrypted form for the authorisation query. Data is only collected which is needed to process orders and which makes it easier for regular customers to use the online shop.

Place of jurisdiction
The business activities of Divina Food AG are based exclusively on Swiss law. The place of jurisdiction shall be Zurich.
